European Data Protection

Judging from the comments that followed the discussion about data protection in europe on scoble’s and other blogs it looks like many people in the US still have a lot to learn about what the European Data Protection actually means and how this data needs to be controlled even if it’s stored in the US covered by the safe harbor privacy framework.

On the other hand, I wouldn’t be so fast as other bloggers to claim it’s Robert’s fault. I don’t think Robert using the data is really the problem, but he provided the data to a third party, which is definitely a breach, but did Facebook take necessary precautions to make sure that protected data made available to Robert is protected in an adequate way as required by safe harbor?
